_________________________________________________________, hereinafter "Tenant(s)" on the behalf of any and all persons occupying and/or visiting the subject premises (403 East Klein, New Braunfels, Texas 78130) during the rental period does forever release, acquit and discharge Daniel Phillips and/or Susan Phillips, and all other persons, firms, or corporations who might be liable, from all claims, demands, charges, costs of court, including attorney's fees and causes of action of whatever nature from all liability and damage of any kind, whether in contract or in tort.

Should Daniel Phillips and/or Susan Phillips have a claim made against either or both of them, Tenant(s) agree(s) to indemnify and defend Daniel Phillips and/or Susan Phillips for any such claim and/or lawsuit.

Further, in the event that a claim and/or lawsuit arises out of the subject rental, and Tenant(s) has(have) a policy of insurance, Daniel Phillips and/or Susan Phillips shall be considered insureds, and/or Daniel Phillips and/or Susan Phillips shall enjoy the benefits of such an insurance policy as though they were named insureds.

Any dispute arising from the rental shall be governed and construed by the laws of the State of Texas. Venue for any dispute shall be in Comal County, Texas; and any such dispute shall be adjudicated by binding arbitration. The costs and expenses of arbitration shall be shared equally by the parties, and each party shall be responsible for its own attorney's fees.

If any part of this Release and Indemnity Agreement is invalid, the remaining portions shall remain in full force and effect.

I(we) have read and understood this Release and Indemnity Agreement, and have signed this Release and Indemnity Agreement without any advice, recommendation, and/or inducement from Daniel Phillips and/or Susan Phillips.

CANCELLATION POLICY

Your $500 deposit on a credit card will hold your reservation. If you cancel 45 days in advance you will lose your deposit. Your signature is required on the release and indemnity agreement with the dates of your reservation filled in.  Once all that is signed and we have your deposit, your reservation is complete.
Reservations are final, No refunds if cancelled or changed.  Final payment for your total rental is due two weeks prior to arrival.  You may mail in a cashier's check/money order or put the final payment on your credit card.

We are NOT required to charge the 7% hotel tax on top of the 6% state tax since we are not in the city limits. We charge the 6% state tax and a $150 cleaning fee.  

HOUSE RULES

The deposit is $500 – if you have paid less we will be charging an additional amount to total $500. It is our prerogative to charge you for additional damages based on reports from our neighbors or police.

No more than 15 people at one time are allowed to visit. There will be an additional charge of $50 per person based on what our neighbors or we observe.

No loud partying or firecrackers allowed. All music must be kept reasonably quiet and no trespassing on our neighbor’s property. Boisterous behavior and foul language will result in the police being called. New Braunfels police have a zero tolerance policy on bad behavior.

You must take the trash to the curb on Sunday evenings as trash is only picked up once a week, early on Monday mornings. Use the large sacks we have available.

No more than six vehicles in the driveway.

Absolutely no smoking in the house. If you must smoke outside pick up your cigarette butts. We charge $1 per butt.

Absolutely no pets allowed. 

You and your party use the hot tub and swim at your own risk. Please keep the hot tub cover locked when not in use.

Absolutely no jumping off the deck or boathouse roof.
